The ex-lawyer for the former president has left her position as New Jersey's top federal prosecutor. This follows a legal ruling that questioned her legal standing to serve.

Acceptance of Resignation

US Attorney General, Pam Bondi, announced Habba's resignation on the start of the week. In a statement that the appeals court finding made it unworkable for the official to effectively run her office.

"Let no one confuse compliance for surrender," she wrote. "This battle will now reach across the country."

Court Ruling

Her resignation was triggered by a federal appellate panel determined that she had been unlawfully serving as the federal prosecutor. This decision is could influence many legal proceedings in the state.

The appellate judges ruled that a acting appointment that skirted Senate approval violated the statute on vacant positions.

Ongoing Legal Battle

The Attorney General added that Habba will remain at the Department of Justice as a top consultant. She will challenge the decision of the disqualification, aiming for a reversal.

Writing online, Bondi argued that the court "should not be able to countermand the executive's selection of attorneys tasked with executing the primary duty of the administration of prosecuting crime."

Performance in Office

The attorney general commended Habba's record and said that while she was in charge, the city of Newark saw a significant drop in offenses. Additionally that the Camden recorded its initial homicide-free summer since 1974 with no murders.

Legal Career

Habba, 41, originally became part of Donald Trump's lawyers in 2021. Subsequently, she represented Trump in his business records case in New York last year, which resulted in his conviction on multiple felony counts of falsifying business records.

Before her appointment to the federal prosecutor position, Trump had revealed he was naming her as his presidential counsellor in a potential future term, labeling Habba as deeply loyal and a dedicated fighter for justice.
